are welcome to inspect the nursery.
Nicholsons reserves the right to substitute plants
where the specified plant is not available, or
to omit them altogether and deduct the cost from
the final bill.

be subject to

Prices and Settlement
All the prices stated in our main Plant List catalogue
(downloadable from the Catalogues
& Brochures page), here on the website,
and around the nursery, are inclusive of VAT at
17.5%.
With the reduction in VAT to 15% (from December
1st 2008) the actual amount charged on any order
will be less than published,
and the actual level of tax charged will be correct
at 15%.
We apologise for any confusion this may cause,
but believe it is better to pass on the reduced
prices to our customers in this way, rather than
embark upon the costly exercise of replacing price
tags, reprinting the catalogue, and revising the
website. If you are in any way unsure about our

Prices
do not include delivery. Delivery can be arranged
at cost – please ask for quotation. Please
also refer to our Delivery
page for further details.
At
the nursery we accept cash, cheques and most major
Credit Cards (except American Express). Account
customers can also pay direct into our bank account
– details of which are included on each
invoice issued.
Nicholsons reserves the right to alter prices
without prior notice. Prices are ex-nursery, unless
quoted for separately. Payment is due in full
on collection (or delivery). For account holders:
payment is due within 28 days of invoice unless
stated otherwise in writing. Thereafter a late
payment surcharge of 10% is payable.
All goods (plants and materials) remain the property
of Nicholsons until the full price has been paid.
However, all liability for the goods shall pass
to the client on collection or receipt of the
goods.
If an order is cancelled we reserve the right
to make a charge for handling and/or administration.
Quotations
Quotations shall be valid for a period of 30 days,
after which the company reserves the right of
withdrawal or modification.
All additional work to that stated in our quotation
will be charged at our current rates and will
be paid in addition to the agreed contract price.
Unless specifically mentioned, the quotation for
the works does not include any watering or maintenance.This
will be the sole responsibility of the Client.
Contracting
Upon completion of the works, the responsibility
for the well-being of the plants will be passed
to the Client. Any planting out of season upon
request of the Client, will be the responsibility
of the Client.
A supply of water shall be made available free
of charge to Nicholsons for the use and requirement
of the landscaping works being undertaken.
The
condition of any plants requested to be salvaged
and replanted shall be the responsibility of the
Client.
Newly laid turf and seed may be subject to slumping
after laying. While all precautions are taken
to avoid this happening, Nicholsons is not ultimately
responsible.
All work may be subject to re-measurement on completion.
Where required, later remedial work will be charged
on day rate unless covered by a provisional sum
elsewhere.
Clients will be asked regarding location of services.
If limited
information is available, CAT scanners will be
used and every effort will be made to safeguard
your property, but ultimately if accidental damage
is caused to services that had not been identified
by the Client, then it will be the Client’s
responsibility.
Guarantee
Nicholsons’ aim is to provide the highest
quality plants and workmanship. If there are any
defects which appear to be Nicholsons’ fault,
these will be remedied as soon as practicable.
Any complaints regarding the quality of the plants,
materials or workmanship should be made as soon
as possible and will be considered only if made
within 7 days of collection, delivery or completion
of the contract.
Nicholsons cannot be held responsible for the
condition of the plants/job after acceptance of
the delivery or signing off of the job; nor for
the replacement of any plants that fail to grow
due to unsuitable soil conditions, inappropriate
choice of plant for site conditions, inappropriate
planting or maintenance (unless under Nicholsons’
advice); adverse weather conditions, lack of maintenance
(unless Nicholsons are contracted to do this),
or other causes beyond Nicholsons’ control.
If a full guarantee is required please feel free
to request a quotation. Forestry plantings should
be expecting an overall survival rate of at least
90% with full maintenance.
General
Nicholsons operates its own Health and Safety
policy.
Nicholsons is insured against Employers Liability
and Public Liability risks.
Nicholsons takes no liability for consequential
loss.
Acceptance of an order implies acceptance of the
above Terms and Conditions.
Availability
Bare Root Plants
are available during the winter season when the
plants are dormant – normally mid- November
to the end of March. We do carry bare root stock
during this time, but advance ordering is recommended.
Container Plants
are available at all times of year, but the best
time of year to plant is still September to May.
Availability will vary throughout the season so
advance ordering is recommended.
